It depends on what the hate speech is on, if it's on hating pistachio ice cream then it should be protected, but if it's something like a racist ideal/belief then it should not be protected by freedom of speech laws

Speech that incites violence should not be protected by freedom of speech laws. A well‐written law will say something like that instead of using the phrase “hate speech”.
